The deal, in plain words.
TourWell is a tour diary that a band, its management and its crew share. These terms are the agreement between you and us about using it. They are written to be read.
Who you are dealing with
TourWell is operated by Richard Martins, trading as SolveWell Apps, a sole proprietor registered in South Africa, at 60 5th Street, Parkhurst, Johannesburg 2193. Where these terms say "we", that is who they mean.
Subscriptions bought on this website are sold by Paddle as merchant of record, which means Paddle is the seller for that transaction and their terms cover the payment itself. Subscriptions bought inside the iOS app are sold by Apple on the same footing. What you get for the money is described here either way.
Your account
You need an account to use TourWell, and it belongs to one person. Keep your password to yourself; anything done from your account is treated as done by you. Tell us at hello@tourwellapp.com if you think somebody else has got into it.
You must be old enough to enter a contract where you live. TourWell is a tool for working musicians and is not intended for children.
What a subscription buys
A subscription is held by the person who pays for it, and it covers a number of artists: acts whose schedule and money you manage. Every other person you invite to an artist is free, however many there are: members, subs, crew and management do not each need a subscription.
Plans renew automatically at the end of each period until cancelled, at the price shown when you bought. If we change prices, the new price applies to new subscribers; yours does not change underneath you without notice.
A trial, where offered, runs once per artist. It is not a promise that the artist can be trialled again later by somebody else.
What happens when a subscription ends
This is the part worth reading carefully, because it is unusual and it is deliberate.
Nothing is deleted. When a subscription lapses, the artists it carried become read-only. Every date, fee, contact and document stays exactly where it is and stays readable by everybody who could read it before. What stops is changing things.
We do it that way because a tour diary is somebody's livelihood, and an app that erases a tour because a card expired is a worse product than one that simply stops accepting edits. Renew and editing resumes, with nothing to restore.
Your content is yours
The schedules, fees, contacts and documents you put into TourWell belong to you and to the artists you work with. We claim no ownership of them. We store and process them in order to run the service, and for nothing else. We do not mine them, sell them, or train anything on them.
Note that a date is shared. A date you were booked on belongs to that artist as well as to you, so leaving or deleting your account does not remove it from their schedule.
What we ask of you
Do not use TourWell to break the law, to store somebody else's personal information without a reason to have it, or to try to reach data belonging to artists you are not part of. Do not attempt to disrupt the service for other people.
You are responsible for what you put in about other people: a guest's name, a colleague's passport number, a promoter's phone number. Have a reason to hold it, and take it out when the reason ends.
What we promise, and what we do not
We will run TourWell with reasonable care and keep it available as much as we practically can. We will tell you about changes that affect what you are paying for.
We do not promise it will never be unavailable, never lose a keystroke, or suit every way of working. TourWell is provided as it is. To the extent the law allows, our liability to you is limited to what you paid us in the twelve months before whatever went wrong, and nothing in these terms limits anything that cannot lawfully be limited.
Keep your own copies of anything you cannot afford to lose. TourWell exports day sheets and itineraries as PDFs for exactly this reason.
Ending it
You can cancel at any time. See refunds and cancellation. You can ask us to delete your account entirely, and we will.
We can suspend or close an account that is being used to harm other people or the service. If we do that to a paying account for any reason other than serious misuse, we refund the unused part.
Changes to these terms
If these terms change in a way that affects what you are getting or what you are agreeing to, the date at the top changes and we say so in the app. Carrying on using TourWell after that means the new terms apply.
Law
These terms are governed by the law of South Africa, and the courts of South Africa have jurisdiction. If you are a consumer somewhere with laws that give you stronger rights, you keep those rights, and this clause does not take them away.
